3. Basis of the Bargain; Exclusions

The Limitations of Liability contained herein are part of the basis of the bargain between you and Master The Art Of Stage Performance and shall apply to all claims of liability (e.g., tort, contract, negligence and warranty) even if Master The Art Of Stage Performance or its affiliates has been told of the possibility of any such damage ad even if these remedies fail their essential purpose.

These limitations of liability do not apply to liability for death or personal injury or for fraud, gross negligence or intentional misconduct or in cases of negligence where a material obligation has been breached, a material obligation being such which forms a prerequisite to our services and on which you may reasonably rely, but only to the extent that the damages were directly caused by the breach and were foreseeable upon conclusion of this Agreement.

4. Severability                                      

In the event any provision or part of this Disclaimer is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Disclaimer, will be inoperative.

5. Waiver

No waiver of any provision hereof shall be effective unless made in writing and signed by the waiving party. The failure of any party to require the performance of any term or obligation of this Disclaimer, or the waiver by any party of any breach of this Disclaimer, shall not prevent any subsequent enforcement of such term or obligation or be deemed a waiver of any subsequent breach.
